WHO IS VELARDE TOURS?

Velarde Tours is a travel agency specializing in luxury tourism experiences and tailor-made trips in Peru, committed to the security and privacy of its users' personal data. Based in Peru, we operate under the framework of Law No. 29733, the Personal Data Protection Law, and its Regulations approved by Supreme Decree No. 003-2013-JUS.

PURPOSE AND APPLICATION

This Privacy Policy has been created to reaffirm our commitment to the security and privacy of the Personal Data of every person who accesses our website or interacts in any way with Velarde Tours, providing transparency about the practices we adopt when processing personal data.

The User must read this Policy in full before accessing and/or providing any Personal Data to Velarde Tours. By using our website or our services, you accept the practices described in this Policy.

• Contact data: residential address, postal code, landline or mobile phone, email address;
• Financial data: credit or debit card information (for payment processing), bank account data (for refunds);
• Travel data: travel preferences, destinations of interest, special needs (dietary, mobility, medical), companions;
• Communication data: query history, communication preferences, survey responses;
• Other data: any other personal data necessary to comply with applicable legislation or provide the requested service.

Velarde Tours does not share Personal Data with third parties, except when: (i) expressly requested or authorized by the User; (ii) Personal Data must be provided to comply with a legal provision or court order; (iii) necessary to fulfill an agreement with the User or resolve disputes/complaints; (iv) necessary to attend to emergencies or force majeure cases; or (v) Personal Data is necessary for Velarde Tours' operating partners to perform functions on its behalf.

PURPOSES OF PROCESSING

Velarde Tours will process Personal Data for the following purposes:

• Identification and/or verification of User identities and information;
• Management and execution of tour reservations, tourist packages and travel services;
• Intermediation of the relationship with suppliers necessary for the provision of services (hotels, transportists, guides, operators);
• Processing of payments and financial transactions;
• Analysis of fraud, chargebacks and refunds;
• Management of the relationship with Users and commercial partners;
• After-sales service for queries, date changes, baggage, among other situations;
• Attention to doubts, complaints or suggestions sent through our service channels;
• Communication and/or marketing and promotions campaigns;
• Investigation and/or measures against suspected or actual violation of this Policy or applicable legislation;
• Compliance with tax and legal obligations;
• Other purposes permitted or required by applicable legislation.

COLLECTION AND AUTHORIZATION

Personal Data may be provided directly by the User or through authorized partners, with the main objective of acquiring the products/services offered by Velarde Tours. The User expressly consents to the processing of their data under this Policy by using our services or providing their data through our website.

For the processing of Sensitive Personal Data, Velarde Tours will request express authorization from the User, except for exceptions provided by law.

STORAGE AND RETENTION PERIOD

Personal Data collected by Velarde Tours will be stored: (i) when in physical format, at the offices of Velarde Tours; and (ii) when in electronic format, on Velarde Tours' own servers and/or on the servers of the contracted cloud service provider, who acts as data processor.

Personal Data will be retained for the time necessary to fulfill the purpose for which it was collected. Ordinarily, the period corresponds from the signing of the contract until the completion of the contracted trip, plus an additional period of five (5) years to comply with legal and/or tax obligations.

After the retention period, Personal Data will be securely deleted or anonymized, unless there is a legal obligation to retain it.

USER RIGHTS

In accordance with Law No. 29733 and its Regulations, any User may contact Velarde Tours to exercise their rights:

• Access: Confirm if their Personal Data is processed by Velarde Tours and obtain information about it;
• Rectification: Request correction of incomplete, inaccurate or outdated Personal Data;
• Cancellation: Request deletion of Personal Data that is no longer necessary for the purposes for which it was collected;
• Opposition: Object to the processing of their Personal Data when there is no legitimate reason;
• Revocation: Revoke consent granted at any time, without affecting the legality of previous processing;
• Information: Obtain information about entities that receive their Personal Data;
• Portability: Request transfer of their Personal Data to another service provider;

To exercise any of these rights, the User must submit a written request attaching a copy of their valid identity document, addressed to: info@velardetours.com. Velarde Tours will respond to the request within ten (10) business days.

SECURITY

Velarde Tours takes all reasonable precautions to safeguard the Personal Data collected, which will be stored in a secure environment and protected in accordance with the physical, technical and administrative procedures normally used to protect this type of information.

We use appropriate security technologies and procedures to protect your data against unauthorized access, modification, disclosure or destruction. However, no security system is absolutely impenetrable, so we cannot guarantee the absolute security of your data.

EXTERNAL LINKS

Velarde Tours may provide external links to third-party websites on any of its platforms. However, Velarde Tours does not validate, endorse or monitor such sites and/or their content. This Policy applies solely to the processing of Personal Data collected through our website.
